1. Controller
The entity responsible for processing the image you uploaded is the operator mentioned on this website.

2. Purpose of Processing
The image you uploaded is used exclusively for the AI-based image editing process you initiated. The editing is carried out by the external service provider OpenAI.

3. Transfer to an External Service (OpenAI)
Your image is transmitted to OpenAI for processing. This processing mainly includes applying an AI filter or another function you selected. The transfer is for this one-time processing only.

4. Data Transfer to a Third Country Outside the EU
OpenAI is based in the USA. There is currently no adequacy decision by the European Commission for this country in accordance with Art. 45 GDPR. However, OpenAI claims to use appropriate safeguards, particularly EU standard contractual clauses (Art. 46 GDPR), to ensure an adequate level of data protection.

5. Duration of Storage
Your image is stored only as long as is technically necessary for the processing operation. No further storage or use for internal purposes occurs as far as this is technically controllable.

6. Legal Basis
Processing is carried out solely on the basis of your explicit consent in accordance with Art. 6 para. 1 lit. a GDPR. The consent is applicable only for each specific image upload.

7. Revocation
You may revoke your consent at any time with future effect. The revocation does not affect processing operations that have already occurred.

8. Your Rights
Under the GDPR, you have the following rights in particular: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and the right to lodge a complaint with a supervisory authority (Art. 77).

9. Confirmation of Image Rights
You affirm that you hold all necessary rights to the uploaded image, particularly copyright and personal rights, and that by uploading, no third-party rights are violated.
